    Other Government Agencies

    The Office of Management and Budget has identified five federal government agencies to interface with the Automated Commercial System (ACS). They are the Fish and Wildlife Service, Federal Communications Commission, Food and Drug Administration, Department of Transportation, and Food Safety Inspection Service (FSIS).

Department of Transportation

    The Department of Transportation (DOT), National Highway Traffic Safety Administration (NHTSA) requires a Declaration for Importation of Motor Vehicles and Motor Vehicle Equipment Subject to Federal Motor Vehicle Safety, Bumper and Theft Prevention Standards (HS-7) be filed for merchandise subject to their review. A sample HS-7 and a summary of the boxes on the form is shown in Appendix J of this publication.

    The DOT has identified, by Harmonized Tariff Schedule (HTS) number, merchandise that may be or is subject to their review. A data field indicating DOT review may be or is required has been added to Record Identifiers V3 and W3 in the ACS HTS file. Positions 193-207 of the tape also indicate merchandise subject to review. For additional information on Record Identifier V3, W3, and the Harmonized Tariff Schedule tape, refer to the Harmonized Tariff Schedule chapter of this publication.

    If an HTS number indicates DOT review may be required, and the merchandise does not contain a DOT requirement, ACS users must certify that the merchandise identified as “may be subject to DOT review” is not subject to the DOT review based on the HTS classification, description or

    intended use. ACS will accept DOT data through ACS even though the DOT indicator is not present in the Harmonized Tariff file.

    Input: Record Identifier DT01 is a mandatory DOT input record required to be transmitted with an OI record. The OA record will be used if entry is disclaimed. Record Identifiers DT02 and DT03 are conditional other government agency input records that can accompany an OI and DT01 record and follow either the H5 (Cargo Release) record or 50, 70, 80, or 81 (Entry Summary) record (whichever is applicable). Either Record Identifiers DT02 or DT03 may follow a DT01, but not both.

    Record Identifier OA is a conditional other government agency declaration record that indicates no other government agency requirements apply. Up to five declarations can be reported on each OA record. Record Identifier OI is a conditional commercial invoice line description record.

    There must be either an OA record or an OI, DT01 (and possibly a DT02 or DT03), for each tariff number flagged in the HTS file as possibly having an other government agency requirement. If multiple DOT lines (Record DT01 through DT03) are reported for the same tariff number, it is not necessary to repeat the OI record for each DOT line if the commercial description remains the same. ACS automatically assumes the commercial description on the OI record previously

    submitted applies. If the commercial description for a DOT line item changes, transmit a new OI record with the appropriate commercial description before the related DT01 through DT03 records.

    The application identifier on Record Identifier B is HI if the DOT records are transmitted after the H5 (Cargo Release) record, or EI (Entry Summary) if the DOT records are transmitted after either the 50, 70, 80, or 81 record (whichever is applicable). For additional information on Record Identifier B, refer to the Application Control chapter of this publication.

Output: There are no DOT output records.

U.S. Fish and Wildlife Service Not Currently Active

    The U.S. Fish and Wildlife Service (FWS) requires that a FWS Form 3-177 (Declaration for Importation or Exportation of Fish or Wildlife) be filed for fish, wildlife, or any commodity containing a fish or wildlife product. Their review of entry documentation is conducted prior to the U.S. Customs and Border Protection (CBP) review. FWS inspectors and agents can review the electronic documentation and may physically inspect the merchandise. The results of the decisions are placed in ACS.

    The FWS has identified by Harmonized Tariff Schedule (HTS) number merchandise that is or may be subject to their review. A data field indicating that FWS review may be or is required has been added to Record Identifiers V3 and W3 in the ACS HTS file. Positions 193-207 of the tariff tape also indicate merchandise subject to FWS review. For additional information on Record Identifier V3, W3 and the Harmonized Tariff Schedule tape, refer to the Harmonized Tariff Schedule chapter of this publication. If the merchandise is or contains an FWS product, the filer must transmit FWS Form 3-177 data to ACS.

    If an HTS number indicates that FWS review may be required, and the merchandise does not contain FWS products, ACS users must certify that the merchandise identified as “may be subject

    to FWS review” is not subject to the FWS review based on the HTS classification or description or intended use. The entry should be disclaimed.

    Since fish or wildlife and wildlife products can be added or made a part of merchandise of virtually any tariff number in the HTS, ACS will accept data contained on FWS Form 3-177 for any entry even if the “must or may be” indicator is not present in the HTS query file. If the tariff record does not contain an indicator for FWS and the imported merchandise contains products or material subject to FWS review, the FWS 3-177 data must still be reported to the FWS.

    Input: Record Identifiers FW01, FW02, and FW03 are mandatory FWS input records that are required to be transmitted with an OI record. The OA record will be used if entry is disclaimed. The OI, FW01, FW02 and FW03 will follow either the H5 (Cargo Release), record or either the 50, 70, 80, or 81 entry summary record (whichever is applicable). For additional information on the H5, 50, 70, 80, or 81 records, refer to the Cargo Release and Entry Summary chapters of this publication.

Record Identifiers FW01, FW02, and FW03 are FWS Form 3-177 line item data records. Record Identifiers FW01, FW02, and FW03 may be repeated in sequence as often as necessary for each FWS line within a CBP line item.

    ACS automatically assumes that the commercial description on the OI record previously submitted applies. If the commercial description for FWS line item changes, transmit a new OI record with the appropriate commercial description before the related FW01, FW02, and FW03 records. There must be either an OA record or an OI, FW01, FW02, and FW03 for each tariff number flagged in the HTS file as possibly having an other government agency requirement. Do not combine the OA record (disclaimer for FW1 HTS flag) with the OI record (invoice description and FWS data) for the same agency within a single tariff number.

    The application identifier on Record Identifier B is HI if the FWS records are transmitted after the H5 (Cargo Release) record or EI if the FWS records are transmitted after either the 50, 70, 80, or 81 (Entry Summary) record (whichever is applicable). For additional information on Record Identifier B, refer to the Application control chapter of this publication.

Output: There are no FWS output records.

Federal Communications Commission

    The Federal Communications Commission (FCC) requires that a FCC Form-740 (Statement Regarding the Importation of Radio Frequency Devices Capable of Causing Harmful Interference) be filed for merchandise identified in the HTS as must or may be subject to FCC review.

    The FCC has identified by Harmonized Tariff Schedule (HTS) number merchandise that may be or is subject to their review. A data field indicating FCC review “may be or is required” has been added to Record Identifiers V3 and W3 in the ACS HTS file. Positions 193-207 of the tariff tape also indicate merchandise subject to review. For additional information on Record Identifier V3, W3 and the Harmonized Tariff Schedule tape, refer to the Harmonized Tariff Schedule chapter of this publication. If the merchandise contains radio frequency devices, the filer must transmit FCC Form-740 data to ACS.

    If an HTS number indicates FCC review may be required, and the merchandise does not contain a radio frequency device, ACS users must certify that the merchandise identified as “may be subject

    to FCC review” is not subject to the FCC review based on the HTS classification or description or intended use. The entry should be disclaimed. ACS will accept FCC data through ACS even though the FCC indicator is not present in the Harmonized Tariff file.

The OI, FC01, and FC02 will follow either the 50, 70, 80, or 81 entry summary record (whichever is applicable). For additional information on the 50, 70, 80, or 81 records, refer to the Entry Summary chapters of this publication.

Record Identifiers FC01 and FC02 are FCC Form 740 line item data records. Record Identifiers FC01 and FC02 may be repeated in sequence as often as necessary. If the commercial description for FCC line item changes, transmit a new OI record with the appropriate commercial description before the related FC01 and FC02 records.

    The FCC flag line item can either be followed by an OA record or an OI record (with the accompanying FCC data). An OI and OA record can not be transmitted together.

    The application identifier on Record Identifier B is EI. For additional information on Record Identifier B, refer to the Application Control chapter of this publication. The FCC data is to be transmitted in the EI application only.

Output: There are no FCC output records.

Food and Drug Administration

    The Food and Drug Administration (FDA) requires that a copy of the CBPF-3461 and supporting FDA documents be filed for merchandise subject to their review.

    The FDA has identified by Harmonized Tariff Schedule (HTS) number merchandise that may be or is subject to their review. A data field indicating the FDA review requirement is present in Record Identifiers V3 and W3 in the ACS HTS file. Positions 193-207 of the tape also indicate merchandise subject to review and/or FDA BTA prior notice requirements. The five FDA HTS indicators are FD4 (FDA Prior Notice and FDA Admissibility Review Required), FD3 (FDA Prior Notice and FDA Admissibility Review May Be Required), FD2 (FDA Admissibility Review Required), FD1 (FDA Admissibility Review May Be Required), and FD0 (Subject to FDA Admissibility Review DO NOT SUBMIT). For additional information on Record Identifier V3, W3, and the Harmonized Tariff Schedule tape, refer to the Harmonized Tariff Schedule chapter of this publication.

    If the HTS number indicates FDA review may be required, and the merchandise is not subject to an FDA requirement, ACS users must certify that the merchandise identified as FD1 or FD3is not subject to the FDA review or is not subject to both BTA prior notice reporting and FDA review requirements based on the HTS classification, description or intended use. If not regulated, the line or entry should be disclaimed. ACS will accept FDA Prior Notice and admissibility data through ACS even though the FDA indicator is not present in the Harmonized Tariff file. FDA will also accept Prior Notice data through ACS when the HTS number is flagged with a FD1 or FD2.

    Input: Record Identifiers FD01, FD02 and FD03 are mandatory FDA input records that are required to be transmitted with an OI record. The OA record will be used if the entry line is disclaimed. Record Identifiers FD04 and FD05 are conditional but are mandatory for BTA. The FD05 records carry the required data for merchandise subject to FDA BTA prior notice requirements. The FD02 and FD03 records must be sent but are not required to contain data. However, the FD02 record must contain at least one unit of measure for merchandise subject to FDA BTA prior notice requirements. These FDA input records should follow either the H5 (Cargo Release) record, 02 (Border Cargo Release) record, or 50, 70, 80, or 81 (Entry Summary) record.

    Record Identifier OA is a conditional other government agency declaration record that indicates that no other government agency requirements apply. Up to five declarations can be reported on each OA record. Record Identifier OI is a conditional commercial invoice line description record.

    There must be either an OA record or an OI along with FDA input records for each tariff number flagged in the HTS file as possibly having an other government agency FDA requirement. If multiple FDA lines (record FD01 through FD05) are reported for the same tariff number, it is not necessary to repeat the OI record for each FDA line if the commercial description remains the same.

    Note: For prior notice information sent through the Independent WP transaction it is necessary to repeat the OI record for each FDA line even if the commercial description remains the same.

    ACS automatically assumes that the commercial description on the OI record previously submitted applies except as in Note above. If the commercial description for a FDA line item

    changes, transmit a new OI record with the appropriate commercial description before the related FD01 through FD05 records.

    The application identifier on Record Identifier B is HI if the FDA records are transmitted after the H5 (Cargo Release) record, HN if the FDA records are transmitted after the 02 (Border Cargo Release) record, or EI (Entry Summary) if the FDA records are transmitted after either the 50, 70, 80, or 81 record (whichever is applicable). For additional information on Record Identifier B, refer to the Application Control chapter of this publication.

    Output: There are no FDA output records for FDA specific data. The BN01 and BN02 records are used to transmit FDA BTA prior notice (PN) error and status messages from CBP to the filer.
