    Marie Curie Positions within the Sixth framework programme for Research and Technological Development of the European Communities

    Applicable to Research Training Networks

Lund University, Department of .................., hereinafter referred to as "the Contractor, and ......................,

    hereinafter referred to as "the Researcher", hereby enter into the following agreement.

2. Research project

The Contractor has received funding for a grant in connection to the project “..............................”, hereinafter

    referred to as “the Project”.

For the Project a contract, number [...................], has been drawn up between the Contractor and the

    Commission of the European Communities, hereinafter referred to as “the Contract”, enclosed as Annex 1.

    Words defined in the Contract have the same meaning in this agreement.

The duration of the Project is [........] months starting from dd/mm/yy. The Researcher will be working under this

    project during XX months from dd/mm/yy until dd/mm/YY in accordance with “anställningsförordnandet”.

The parties undertake to carry out applicable parts the Project in accordance with the Contract.

3. [Applicable if the researcher is appointed for more than 6 months] Personal Career Development Plan

     The Contractor ensures that a Personal Career Development Plan is established by the Researcher and the

    Scientist in charge at the time of the appointment in accordance with the Contract. This Personal Career

    Development Plan is enclosed to this agreement as Annex 2. The Researcher will be trained and transfer

    knowledge under the Project in line with his / her Personal Career Development Plan.

    Recourses and Mobility Activities

A description (abstract) of the Research Human Resources and Mobility Activities is established by the

    Contractor. This description is enclosed to this agreement as Annex 2.

    The description and the timetable for the implementation of the Research Human Resources and Mobility Activities.

    The description and the timetable for the implementation of the Research Human Resources and Mobility Activities are enclosed to this agreement as Annex 2 A.

    4. Contractor?s obligations

The Researcher is covered under the social security scheme, which is applied to employees at the Contractor?s

    institution and the social security scheme covers the researcher at any place of the implementation of the Project.

    The Researcher enjoys the same standards of safety and occupational health as those awarded to researchers at the Contractor?s institution holding a similar position.

The Researcher has during the implementation of his/her Researcher Human Resources and Mobility Activities

    the means, including the infrastructure, equipment and products for implementing the Project in the scientific

    and technical fields concerned.

The Researcher is entitled to reasonable assistance in all administrative procedures required by the Contractor?s

    relevant authorities, as well as all administrative procedures , such as visas and work permits required by the

    relevant authorities of the Contractor where the Researcher may carry out a Secondment period.

The Researcher is trained under the Project for the time specified in the Agreement and according to the

    Contract and in line with the Personal Career Development Plan, if applicable. The Researcher holds a full time

    position under this project.

    The Contractor ensures that the Researcher, if registered for PhD studies, enjoys tutoring and supervising arrangements that includes academic support of adequate quality by a specified academic supervisor.

5. Researcher?s obligations

The Researcher is aware of the contents of the Contract and will carry out his/her work in such a way that the

    Contractor will be able to fulfil its duties towards the Commission.

    The Researcher is solely responsible for ensuring fulfilment of [his/her] obligations under the Swedish law and where appropriate, bilateral agreements.

The Researcher for his / her Research Human Resources and Mobility Activities shall not be allowed to receive

    other income than those received from the Contractor in accordance with this agreement.

The Researcher undertakes to devote [himself/herself] full-time to his/her Research Training Activities, unless

    there are duly justified reasons connected to personal or family circumstances.

    The Researcher shall inform the Contractor as soon as possible of circumstances likely to affect the performance of the Contract, such as:

- where applicable, any significant modification relating to this agreement and / or his / her Personal Career

    Development Plan;

    - a pregnancy or sickness that may directly affect the implementation of this agreement.

The Researcher commits him/herself to complete, sign and transmit to the Contractor the evaluation and follow-

    up questionnaires, provided by the Commission, at the end of the Researcher Human Resources and Mobility

    Activities.

The Researcher commit him/herself to keep the Contractor informed during three years after the end of the

    Project of any changes in his/hers contact details.

6. Provisions for annual and sickness leave

The provisions for annual and sickness leave according to the internal rules of the Contractor are stated in

    “anställningsförordnandet” (Employment contract, Annex 3).

7. Intellectual and industrial property rights

    The rules relating to intellectual and industrial property rights in the Contract (Annex II, Part C and Annex III, Part C) will be complied with.

    Knowledge as defined in the Contract shall be owned by the Party who carried out the work generating the Knowledge.

In accordance with the Contract (Annex II.29), the owner of the Knowledge shall provide adequate and effective

    protection for it. The Researcher will provide adequate protection to Knowledge which he / she is owns.

The Researcher will grant Access Rights to Pre-Existing know-how and Knowledge in accordance with the

    Contract (Annex II.32).

The Researcher enjoys, on a royalty-free basis, Access Rights to Pre-Existing know-how and Knowledge needed

    for his / her Research Training Activities.

The Contractor has the right to use knowledge free of charge (on a royalty-free basis) in research, teaching and

    education.

8. Publicity

The Researcher shall communicate, publish and disseminate results generated within the Project in accordance

    with the Contract (Annex II.12 and II.30.3).

The Contractor has the right to examine any material and results before publication during a period of 30 days.

    The Contractor may prevent publication of confidential information.

    The Researcher will acknowledge the support of the Community under a Marie Curie Research Training Network in any related publication or other media as stated in the Contract (Annex II.12 and Annex III.7 ).

9. Confidentiality

    The rules relating to confidentiality in the Contract (Annex II.9 and Annex III.6) will be complied with.

Information concerning the research at the Contractor, not developed by the Researcher, or other information

    expressly communicated as being confidential must be kept confidential by the Researcher. Such information

    may not be disclosed to a third party without a written agreement by the Contractor. This does not apply to

    information which

- was already known to the Researcher prior to disclosure

    - was rightfully received from a third party without any undertaking of confidentiality - is or becomes available to the public otherwise than through any act or omission of the Researcher.

10. Amount to be received by the Contractor from the Commission to the benefit of the researcher

11. Arrangements for payment

The Researcher will receive the following amounts, pursuant to the Contract.

Deductions on living, mobility and travel allowances will be made by the Contractor for taxes and social

    security in accordance with Swedish regulations. *) The rate of deduction for social security is described and justified in Annex 4. Adjustments to the rates of deduction for taxes and social security will be made 1st January each year in accordance with any changes in the Swedish regulations.

All payments will be in Swedish kronor. For payments to the Researcher the following conversion rate will be

    used: ................. SEK/ Euro (Source: ECB date: dd/mm/yyyy). The conversion rate shall be regulated yearly in accordance with the auditing rate upon each financial report and the payments to the Researcher will be adjusted

    accordingly.

This means after deductions for social security but before taxes:

Payments will be made in monthly instalments according to “anställningsförordnandet” (Employment Contract).

The travel allowance will be paid as a flat rate amount upon arrival and once a year during the following years

    when applicable. Deductions for taxes and social security will be made accordingly.

    If applicable- Career Exploratory Allowance will be paid out after the first year. Deductions for taxes and social security will be made accordingly.

12. Applicable law and jurisdiction

The law of Sweden shall govern this agreement.

13. Termination of this agreement

In the case the Contract is terminated by the Commission of the European Communities this agreement will also

    be terminated. Notwithstanding the termination of the agreement, the provisions in the Contract Part C of Annex

    II and articles 7, 8 and 9 of this agreement shall continue to apply.

This agreement has been drawn up in two originals, one for each part.
