Dear Business Owner:

    Thank you for your interest in participating in the Santa Clara Valley Transportation Authority’s (VTA) Small Business Enterprise (SBE) Program. The SBE Program is a race and gender-neutral program designed to increase the availability of contracting opportunities for small businesses on VTA’s state or locally funded contracts.

To be eligible for VTA’s SBE program, your firm must meet BOTH of the following requirements:

    1. Your firm, including affiliates, must be a small business as defined by Small Business Administration (SBA)

    regulations, 13 CFR Part 121, under the North American Industrial Classification System (NAICS). The

    specific annual gross receipts total will vary depending on the type of business and/or the type of services

    rendered. Applicants should verify the appropriate maximum gross receipts for their type of business.

    2. Even if your firm passes the above requirement, it cannot exceed, including affiliates, a maximum of $22.41

    million in combined average annual gross receipts over the past three years. Some SBA size standards are

    higher than $22.41 million. Example: although a general contractor meets the SBA size standard of $28

    million in average annual gross receipts, it could exceed the $22.41 million average and will not be eligible

    for VTA’s SBE program.

Other SBE Certification Criteria (including above two requirements)

    ; SBE firm owners are not bound by ethnicity, race or gender requirements. The SBE program is a race and gender

    neutral program. Information on the ethnicity and gender of the firm’s owners is for informational purposes only.

    ; The firm’s management and daily business operations must be controlled by individuals who are citizens or

    lawfully admitted permanent residents of the United States.

    ; A firm certified as a Disadvantaged Business Enterprise (DBE) under Title 49 CFR Part 26 of the U.S.

    Department of Transportation qualifies as an SBE and does not need to obtain further SBE certification. If you

    believe your firm may qualify as a DBE and wish to be certified as such, please go to this website for more
