     NOTICE INVITING TENDER

    Appointment of Private Recovery Agents (On Commission Basis) for the pursuit and collection of BSNL’s Outstanding dues of Basic Telephone and Cell Phone ND[2 CALL]

     Applications Cum Bids in the prescribed format are invited on behalf of BSNL, Jharkhand Telecom Circle, Ranchi for appointment as Private Recovery Agents for realization of dues on commission basis for its six Telecom Districts from the following eligible Individuals/Institutions as below:-

     (1) Retired employees of DOT/DTS/BSNL/MTNL/Dept. of Posts (2) Small Savings/PLI agents (3) Development Officers/Debt Recovery Agents of reputed Public Sector Banks /Financial Institution. (4) Debt Recovery Agents of Other Telecom Service Providers/BSNL Franchisees and Marketing Agents.

     For Individuals, the age at the time of application shall not be more than 65 years.

     Interested eligible Individuals/Institutions are required to collect the terms and

    conditions and the prescribed application/BID Format from Sri R.C Mahto, Accounts

    Officer (TRC), O/o CGMT, Jharkhand Telecom Circle, 3rd Floor, Telephone Bhawan, Near Saheed Chowk, Main Road, Ranchi-834001 on production of

    payment receipt of the cost of the bid document, which is Rs.50/- ( Rupees fifty) only.

A:

    Instructions to the Bidders for submission of BIDS

    1. Applications Cum Bids in the prescribed format are invited on behalf of BSNL,

    Jharkhand Telecom Circle, Ranchi for appointment as Private Recovery Agents

    for realization of dues on commission basis for its six Telecom Districts from the

    following eligible Individuals/Institutions as below:-

     Issue of BID Documents by O/o CGMT, Jharkhand Telecom Circle, 3rd Floor,

    Telephone Bhawan, Near Saheed Chowk, Main Road, Ranchi-834001 on all

    working days from date 22.08.2006 to 11.09.2006 between 11.00 Hrs to 16.00 Hrs. However, the terms and conditions and the prescribed application/BID Form can also be downloaded /printed for using it for bidding within the prescribed date from our website www.jharkhand.bsnl.co.in

    4. Cost of the Bid documents - Rs.50/- (Rupees fifty) only non-refundable.

     Earnest Money Deposit (EMD) - Rs.10000/- (Rupees ten thousand) only. No

    interest will be paid by BSNL on the EMD

    amount.

     Last Date/Time of Receipt of BIDS - 11.09.2006 upto 16 hours.

     Opening of BIDS - On 11.09.2006 at 16.30 hours.

    5. EMD and Cost of BIDS may be paid in Cash or in form of Demand Draft drawn

    in any nationalized Bank at Ranchi in favour of A.O (B&A), O/o C.G.M.T, J.T.C,

    Ranchi.

    6. The filled up BID form along with the prescribed documents may be dropped in a sealed envelop between 11 AM to 4 PM during working days in the TENDER DROP BOX placed at the 3rd Floor of our above mentioned office latest by 4 PM thof 11 Sep‟2006. The application/BID can also be sent by Registered/Speed Post to Sri R.C Mahto, AO (TRC), O/o CGMT, Jharkhand Telecom Circle, 3rd Floor, Telephone Bhawan, Near Saheed Chowk, Main Road, Ranchi-834001 so as to reach him latest by 16.00 hrs of 11/09//2006.

    7. The Circle shall appoint upto Three Nos. of Recovery Agent for all its SSAs.

    8. Number of Telecom. Districts - Six Nos. viz. Ranchi, Jamshedpur, Dhanbad, Hazaribagh, Dumka and Daltanganj.

    9. Eligibility appointment of Private Recovery Agents and selection

(a) Retired employees of DOT/DTS/BSNL/MTNL/Dept. of Posts.

    (b) Small Savings/PLI agents, who have been registered with DOP/Small

    Savings Organizations of State Government for at least one year on the

    date of application.

    (c) Development Officers, who have been registered with Central

    Government „s Insurance Companies for at least one year on the date of

    application.

    (d) Debt Recovery Agents of reputed Public Sector Banks /Financial

    Institution who have been functioning in such a capacity for at least one

    year as on the date of application.

    (e) Debt Recovery Agents of Other Telecom Service Providers with at least

    one year functional experience in this field with such other Telecom

    Service Providers.

    (f) BSNL Franchisees and Marketing Agents.

    Note: For Individuals, the age at the time of application shall not be more

    than 65 years. Relevant document for establishing proof of the

    eligibility is required to be submitted along with the application/bid.

    10. The bidder is required to fill up the financial bid as in annexure II of this document.

    11. Commissions:-The maximum commission shall be payable @ 15% to the

    Agents of Collections for more than 2 years old outstandings for all telecom

    services (Basic/CMTS etc.) for realization of outstanding telecom dues. The offer

    by a bidder should be within the above limit and should clearly be made in terms

    of the amount (in whole rupees) that the bidder proposes to keep as his overall

    commission, against each Rupees one thousand of arrears actually recovered by

    him.

    12. The offer shall be accompanied by Earnest Money Deposit (EMD) either in Cash

    or Demand Draft equivalent to Rs.10000/- (Rupees ten thousand) only. The EMD

    is liable to be forfeited in case a successful bidder fails to sign the contract within

    30 days of being asked to do so.

    13. The Recovery Agents shall also be eligible for an additional commission (which

    shall not be the part of evaluation process of BIDS), over and above the amount

    actually due to him in terms of the BIDS, for recovery of old outstanding dues

    relating to telecom services including CMTS.

     For realization of O/s dues in respect of Telecom Services including CMTS

    14. The completed filled up bid form shall contain the following

    documents/enclosures (check list for submitting the bids)

    a. Instructions and Guidelines to the Bidders for submission of BIDS and Terms and

    Conditions (duly signed on all 3- 12 pages)

    b. Relevant document for establishing proof of the eligibility/(Age proof in case of

    individuals) of the bidder

    c. Address proof and PAN card copy

    d. Duly signed Financial bid as at annexure II (page 13 of the bid document)

    e. Proof of payment of Bid document cost (Rs.50/-)

    f. Earnest Money Deposit (EMD) either in Cash (cash receipt of our office) or

    Demand Draft equivalent to Rs.10000/- (Rupees ten thousand) only.

    The bidders using internet downloaded forms may combine the two payments and

    submit a demand draft of Rs.10050/- for cost of document plus the EMD.

B:

    Terms and Conditions

    1. The bids shall remain valid for 210 days from the date of opening of BIDS. The

    period of bids validity may be extended by the BSNL.

    2. The bidder whose offer is evaluated as the lowest shall be appointed as the

    Recovery Agent.

    3. The Recovery Agent shall be issued with an appropriate Identity Card and also

    an authorization letter by the Circle. The Agent should display the ID Card before

    taking necessary actions for recovery of dues with any (ex)-customer or before

    entering his/her premises. The authorization letter shall mention prominently

    that the Agent is authorized to collect the outstanding dues only by cheque not

    in cash.

4. The SSAs will suitably publicize:

    (a) The details of the Recovery Agents appointed though local press for the

    information of BSNL‟s customers; and

    (b) The fact that the Agents are not authorized to collect payment of arrears

    in cash but by Account Payee cheque or DD only drawn in favour of

    “Bharat Sanchar Nigam Limited”.

    5. The Agent, or BSNL, may terminate the contract by giving one moth‟s notice in

    writing in advance.

    6. The Recovery Agent shall act immediately after the work is awarded to him and

    try to get the collections in respect of the outstanding TR dues entrusted to him

    realized from the very first month of the contract.

    7. The activities to be performed for recovery and deposit of the dues collected by

    the Recovery Agent vis-à-vis the TRA unit of the SSA are as under:

    8. The TR Branch of the SSA will supply, to the Recovery Agent, authenticated

    copies of the TRA-20 Statements (Exchange-wise) containing the details of the

    outstanding arrears, together with the bills for collecting payment from the

    customers of the closed telephones. The bills will be super scribed at the top with

    the words “Defaulter Case” in red ink.

9. The Recovery Agent may, in deserving case allow payment in a limited numbers

    of installments. This discretion is however to be exercised sparingly. In such

    cases, part bills may be issued by the Agent with a suitable indication on the

    payment voucher like “Installment Case; Defaulter of Closed Telephone”.

10. Recovery of dues from State/Central Government

    Departments/Corporations/Local Bodies/Public Undertakings shall also be

    included in the present scheme.

    11. The Agent shall be authorized to collect payment through an Account Payee

    crossed cheque or DD only drawn in favour of “BHARAT SANCHAR NIGAM

    LIMITED”. Payment shall on no account be received by the Agent in cash.

    12. The Agents shall deposit the collection made from subscribers at BSNL‟s Cash

    and Cheque Counters of the concerned city latest by next working day of

    collections invariably.

    13. The Agent shall be liable to pay the penalty @ 1% of collections made per day in

    case of delayed deposits.

    14. The Agent may issue a temporary receipt to the customer initially to be followed

    by a formal receipt by BSNL. The Agent may be permitted to issue such

    temporary receipts on his/her letter pad under his/her seal and dated signatures.

    The format of temporary receipt is suggested below.

    15. The Agent will deposit the payment (s) collected by him/her through

    cheques/DDs with A.O (Cash) of the SSA concerned under a covering list (TRC)

    containing the details like Telephone Number, Subscriber‟s Name and Address,

    amount of bill (s) collected, date of bill (s), Cheque/DD Number and date. The list

    will be prepared (in triplicate) for closed telephones supported by duplicate

    copies of bills presented to the customer against, which such payments have

    been collected. This is to ensure proper accounting of the collections made by

    the Agent in the customer account.

    16. For closed defaulter telephones outstation cheques/DDs may also be accepted

    and their expenses shall be borne by BSNL.

    17 The A.O (Cash), BSNL will credit the collections made by the Agent as in para 15

    above into the account immediately. A receipt in form Eng.9 shall be made out

    for each payment of the telephone bill collected by the Agent.

    18. A copy of Telephone Revenue Collection list (TRC) will be sent by the A.O (Cash)

    to TRA for payment noting etc. in the usual manner. This list will be superscripted

    at the top with the words “Collections Made Against Closed Telephones” to

    facilitate crediting of the payment into proper ex-subscriber‟s accounts.

    19. The SSA will send the formal payment/receipt (prepared as per para 17 above)

    alongwith the paid copy of the bill to the customer (s) either by ordinary post or

    through the Agent, as considered economical and expedient by the Head of the

    SSA. In the latter case, the Eng.9 receipts shall be handed over to the Agent

    (under proper receipt) for delivery to the (ex-) customers.

    20. During the course of Interaction with the customers, the Agent may come across

    cases where the customers have already paid the bills and TRAO records show

    them as “outstanding”. In such cases, the Agent will politely request the

    customers to provide suitable evidence of payment (e.g. a photocopy of the entry

    in his/her Bank Pass Book or of a receipt issued by the office where paid)

    alongwith a copy of the paid bill. The Recovery Agent shall furnish the details of

    such cases to the concerned A.O (TR) separately, indicating the telephone

    number, customer‟s name and address, date & amount of bill, particulars of

    payment (office, date and amount paid). No separate commission will be

    admissible to the Agent on this account.

21. Security Deposit:

    (i) The Agent shall be liable to deposit an amount of Rs.20000/- (Rupees

    twenty thousand) only as non-interest bearing security deposit for proper

    fulfillment of the contract either in Cash or in the form of Bank

    Guarantee/NSC pledged to the Circle Office. For this, successful bidder

    may choose to convert his EMD into a part of the Security Deposit. (ii) The amount of Security Deposit shall be deposited before the contract is

    entered into.

    (iii) The Security Deposit recovered under 21 (i) above shall ordinarily be

    refunded within two months after the expiry or termination of the contract.

    22. General Conditions including Code of Conduct:

    (i) The Recovery Agent shall be held personally responsible for any damage

    caused to the customer while pursuing the recovery of dues. The

    company shall not be a party to such disputes.

    (ii) The security Deposit shall be forfeited and license cancelled for any act of

    high handedness of the Agent towards the customer, which brings bad

    name to the company.

    (iii) BSNL shall be free to take any action (including legal recourse) as

    deemed fit against the Agent for his failure to follow the terms &

    conditions of the Agreement.

    (iv) The Recovery Agent shall work under the control of Officer-In-charge of

    the Outstanding Pursuit Cell in the SSA.

    23. The scheme shall be applicable mutatis mutandis to CMTS Units in each SSA. The agent selected for the SSA will also be given the work relating to CELLULAR subscribers of that SSA. The distribution of the outstanding dues among the agents in an SSA (area/exchange- wise amount wise list) for recovery from the subscribers shall be done by the SSA head in consultation with his IFA.

    24. Commissions:

    The maximum commission shall be payable @ 15% to the Agents of Collections for more than 2 years old outstandings for all telecom services (Basic/CMTS etc.) for realization of outstanding telecom dues. The age of the outstanding dues will be determined with reference to the actual date of payment from its original bill date.

    25. Terms and Conditions:

    The offer by a bidder should be within the above limit and should clearly be made in terms of the amount (in whole rupees) that the bidder proposes to keep as his overall commission, against each rupees one thousand of arrears actually recovered by him. The offer shall be accompanied by Earnest Money Deposit (EMD) either in Cash or Demand Draft equivalent to Rs.10000/- (Rupees ten thousand) only. The EMD is liable to be forfeited in case a successful bidder fails to sign the contract within 30 days of being asked to do so.

    26. The Recovery Agents shall also be eligible for an additional commission (which

    shall not be the part of evaluation process of BIDS), over and above the amount

    actually due to him in terms of the BIDS, for recovery of old outstanding dues

    relating to telecom services including CMTS.

27. The responsibility of the Agent:

    The Recovery Agents shall collect outstanding telecom revenue arrears from

    subscribers of Closed Telephones/Cell Phones/Telex/Private Wires/Circuits etc.

    28. Though the Scheme shall be an open ended scheme now, i.e. not required to be

    renewed periodically, the appointment of the Recovery Agent to collect

    outstanding telecom revenue arrears from subscribers of Closed Telephones/Cell

    Phones/Telex/Private Wires/Circuits etc. while signing the contract shall,

    however, initially be for a period of six months only, on experimental basis.

    29. The appointment shall be extendable by another six months depending upon the

    performance of the Agent.

    30. In any case, however, fresh bids should be called for after expiry of one year

    from the date of award of contract against the previous bids.

    31. Only those cases where the facility was closed more than two years back will be

    handed over to these Agents for collection.

    32. The performance of an Agent shall be evaluated by a committee comprising of

    the Head of the SSA, IFA of the SSA, and DGM (TR) or CAO (TR) or AO (TR) of

    the SSA (as the case may be). The evaluation shall be completed at least 15

    working days before the expiry of the existing term and forwarded immediately to

    the Circle Office, so that the case for extension is decided in time.

    33. In case of any dispute arising out between the agent and the BSNL the decision

    of the CGMT, BSNL, Jharkhand circle will be final.

    34. The above terms and conditions as well as any modifications done by BSNL shall

    be acceptable to the bidder/agent.
