    NOTICE OF MAKING A GATING ORDER

    SECTION 129A HIGHWAYS ACT 1980

    CLARK AVENUE, CHEQUER AVENUE, STOCKIL ROAD AND WAINWRIGHT ROAD AT HYDE PARK

    GATING ORDER 2011

     rdNotice is hereby given that Doncaster Borough Council („the Council‟) has on the 3 day of August 2011

    made a Gating Order under Section 129A of the Highways Act 1980 and of all other enabling powers for the thpurposes of reducing crime and antisocial behaviour. The Order will come into effect on the 8 day of August

    2011

    The effect of the Order will be to restrict at all times the public right of way over the highways at the rear and/or side of properties bearing numbers 2 to 8 inclusive (even numbers only) Wainwright Road, 7 to 29 inclusive (odd numbers only) Clark Avenue, 29 to 49 inclusive (odd numbers only) Chequer Avenue, 1 to 7 inclusive (odd numbers only) Wainwright Road, 9 to 23 inclusive (odd numbers only) Wainwright Road, 6 to 28 inclusive (even numbers only) Clark Avenue and 5 to 35 inclusive (odd numbers only) Stockil Road all of which are situated within the Hyde Park area of Doncaster

    Alternative routes for pedestrians and vehicles are available by using the highways to the front of properties bearing numbers 2 to 8 inclusive (even numbers only) Wainwright Road, 7 to 29 inclusive (odd numbers only) Clark Avenue, 29 to 49 inclusive (odd numbers only) Chequer Avenue, 1 to 7 inclusive (odd numbers only) Wainwright Road, 9 to 23 inclusive (odd numbers only) Wainwright Road, 6 to 28 inclusive (even numbers only) Clark Avenue and 5 to 35 inclusive (odd numbers only) Stockil Road all of which are situated within the Hyde Park area of Doncaster.

The Order is set out in the Schedule below

    A copy of the Order, together with a plan are available for inspection at (i) Central Library, Waterdale, Doncaster during normal opening hours (ii) the offices of the Council‟s Community Safety Consultant at

    Concorde House White Rose Way Doncaster between the hours of 10am and 4pm Monday to Friday and (iII) the offices of the Council‟s Legal Services Unit, Copley House, Waterdale, Doncaster between the hours of 10am and 4pm Monday to Friday

    Anyone wishing to question the validity of the Order or of any of the provisions contained therein on the grounds that the Council had no power to make it or that any requirement under Part 8A of the Act has not been complied with in relation to the Order may within six weeks from the date on which the Order was made apply to the High Court for this purpose

    HIGHWAYS ACT 1980 SECTION 129A

Doncaster Borough Council (“the Council”) in exercise of its power under section 129A of the Highways Act

    1980 (“the Act”) and of all other enabling powers being satisfied that premises adjoining or adjacent to the highway are affected by crime or anti-social behaviour, the existence of the highway is facilitating that crime or anti-social behaviour and it is expedient to make the Order for the purposes of reducing that crime or anti-social behaviour hereby make the following Order:-

     th1 This Order shall come into operation on the 8 day of August 2011 and may be cited as Doncaster

    Borough Council Clark Avenue, Chequer Avenue, Stockil Road and Wainwright Road at Hyde Park Doncaster Gating Order 2011

    2 Except as provided in Article 3 to this Order no person shall use the public right of way over the highway (“the highway”) described in Part One of the Schedule to this Order at any time

    3 The restriction in Article 2 to this Order shall not apply to any person who lives in premises adjoining the section of highway affected and anyone authorised by them or to any business premises adjoining the highway or to any Police, Ambulance or Fire Service personnel acting in pursuance of statutory powers or duties, persons acting in their capacity as officers of the Council in pursuance of statutory powers or duties or anyone authorised by the Council or to any statutory undertaker, gas, electricity, water or communications provider requiring access to their apparatus situated in the highway.

    4 The alternative route for pedestrians and vehicles affected by this Order is by using the public right of way over the highway described in Part Two of the Schedule to this Order

    5 The Council is satisfied that the conditions set out in Section 129A(3) of the Act have been met in relation to this Order.

    6 The installation, operation and maintenance of lockable gates to enforce the restriction of public rights of way is hereby authorised.

    7 Maintenance and operation of the gates will be the responsibility of Doncaster Borough Council. If you need to contact the Council regarding the gates please telephone the Council‟s Community Safety Consultant

8 This Order will be available for inspection at the offices of the Council‟s Legal Services Unit, Copley thHouse, Waterdale, Doncaster for a period of one year from the 8 day of August 2011 and will be published

    on the Council‟s website.

    9 This Order will be registered in the Register of Gating Orders, at the offices of the Council‟s Community Safety Consultant at Concorde House White Rose Way Doncaster and a copy of the Order will be available to members of the public on payment of a reasonable charge.

    10 The interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament

    4 That highway to the side of 6 Clark Avenue, the side of 5 Stockil Road and at the rear of properties bearing numbers 9 to 23 inclusive (odd numbers only) Wainwright Road all at Hyde Park Doncaster

    5 That highway at the rear of properties bearing numbers 6 to 28 inclusive (even numbers only) Clark Avenue and 5 to 35 inclusive (odd numbers only) Stockil Road all at Hyde Park Doncaster
