MINUTES OF PROCEEDINGS

    At a meeting of the Town Planning (Applications) Sub-Committee No. 3 on Thursday 27 April 2000 at 6pm, at City Hall, Victoria Street, SW1.

1. MEMBERSHIP

    The Sub-Committee noted that Councillors Justin PowellTuck, Barbara

    Grahame and Glenys Roberts had replaced Councillors Angela Hooper, Ron

    Harley and Barbara Schmeling.

2. MINUTES

    The Chairman, with the assent of the members present, signed the Minutes of

    the meeting held on 2 March 2000.

3. PLANNING APPLICATIONS

    The Director of Planning and Transportation submitted reports in relation to

    the following applications for determination by the Sub-Committee, copies of

    which are included in the Register in the custody of the Chief Executive.

    (1) 18A8 Brook Mews North W2 (TP 22777) (1) Variation of Condition 6

    of decision granted on appeal 19 February 1999 (RN 981037) namely to

    enable a revised car parking layout to be implemented. (2) Details of

    automatic car parking gates and ventilation to car park pursuant to Conditions

    7 and 8 of decision granted on 19 February 1999 (98103617); for part

    demolition, part redevelopment and part change of use to provide 34 flats and

    33 car parking spaces within ground floor car parks.

    Additional representations were received from local residents.

    RESOLVED:

    That planning permission be granted in accordance with the recommendation

    of the Director of Planning and Transportation, subject to the proposed

    condition No.2 being replaced with the new noise attenuation condition

    recently adopted by the Licensing Working Party, and with an informative to

    the applicant requesting that notices be posted to the effect that cars should

    not have engines running inside the garage.

(2) Council Offices, 313319 Harrow Road W2 (TP 19306) Alterations to

    the permission dated 26 November 1998 (RN 9807293) for partial demolition and partial refurbishment to provide 40 self-contained flats 'One Stop Shop 'namely the retention of 3 velux rooflights on the southern elevation.

     RESOLVED:

     That planning permission be granted without conditions.

(3) 14A Garway Road W2 (TP 9887) Erection of new building comprising

    basement and five storeys to provide three self- contained residential flats.

     RESOLVED:

    That consideration of this application be deferred to permit officers to address the concerns of the Environmental Health Officer and to seek improvements to the detailed design, namely a better relationship with the adjoining building, better treatment of the ground floor frontage, and the design and number of side windows.

(4) 578580 Harrow Road W10 (TP 5872) 1. Serve a Notice under Section

    215 of the Town and Country Planning Act 1990 to improve the external appearance of the building. 2. Serve a Repairs Notice under Section 48 of the Planning (Listed Buildings and Conservation Areas) Act 1990 for the proper preservation of the building. 3. Serve an Urgent Works Notice under Section 54 of the Planning (Listed Buildings and Conservation Areas) Act 1990 to secure urgent repairs to the building.

    Additional representations were received from Councillors Alan Lazarus and Katy Thorne.

RESOLVED:

    That, in accordance with the recommendation of the Director of Planning and Transportation:

Section 215 Notice, Town and Country Planning Act 1990

    1. That having regard to the adverse effect on the amenity of the area in which the property is situated a Notice be served by the Director of Legal Services under Section 2 15 of the Town and Country Planning Act 1990.

    2. That the Notice take effect 40 days after service and require that within 6 months of the Notice taking effect the steps specified in Annexe A will be taken for remedying the condition of the property.

    3. That authority for the service of the S.2 1 5 Notice also include authority to withdraw any such Notice and serve further Notices if it becomes necessary to do this in order to remedy the condition of the premises referred to in this report.

    4. That in the event of the Notice taking effect and not being complied with, authority be given for works in default to be carried out in accordance with Section 219 of the Town and Country Planning Act 1990 and subject to compliance with the contract Code of Practice for officers to take all

    necessary action.

    Section 48 Notice, Planning (Listed Buildings and Conservation Areas ) Act 1990

    5. That having regard for the proper preservation of this listed building's special interest, a Notice be served by the Director of Legal Services under Section 48 of the Planning (Listed Buildings and Conservation Areas) Act 1990.

    6. That the Notice take effect 40 days after service and require that within 6 months of the Notice taking effect the steps contained within Annexe B shall be undertaken for remedying the condition of the property.

    7. That authority for the service of the S.48 Notice also include authority to withdraw any such Notice and serve further Notices if it becomes necessary to do this in order to remedy the condition of the premises referred to in this report.

    Section 54 Notice, Planning (Listed Buildings and Conservation Areas) Act 1990

    8. That having regard to the urgent need for repairs to arrest the decline of this listed building's special interest, a Notice be served by the Director of Legal Services under Section 54 Planning (Listed Buildings and Conservation Areas) Act 1990.

    9. That the Notice takes immediate effect upon service and that on expiration of 40 days from the date of the Notice that the City Council will carry out the urgent works specified in Annexe C.

(5) Site at 4650 Tufton Street and 2537 Marsham Street, SW1 (TP

    1810) Alterations in the course of construction (permission dated 23 February 1998): amended roof and addition of louvres at sixth floor to Marsham Street building, amended party wall with the church and addition of gates to Millicent Fawcett Hall entrance.

RESOLVED:

That this application be deferred to the next full meeting of the Sub

    Committee.

(6) Chelsea Barracks, Chelsea Bridge Road SW1 (TP 3735) Provision of

    new vehicular access and gate onto Ebury Bridge Road.

RESOLVED:

    That planning permission be granted in accordance with the recommendation of the Director of Planning and Transportation.

(7) Temple Station, Victoria Embankment WC2 (TP 2355) Temporary

    use from 2 May 2000 to 31 October 2000 of area of approximately 1.5m x 7.5m in south east corner of roof terrace for tables and chairs (daylight hours only) in association with Shoeless Joe's Bar & Restaurant (Class A3).

    Additional representations were received from the Howard Hotel and from the Environmental Health Officer.

RESOLVED:

    That planning permission be granted in accordance with the recommendation of the Director of Planning and Transportation, subject to an additional condition to allow the erection of umbrellas (subject to further details) if required.

(8) 54 Chester Square SW1 (TP 23096 / 5720) Alterations and extensions

    including rear extension to 2nd floor level, basement and ground floor infill conservatory, link bridge to mews property and alterations to 54 Ebury Mews including basement swimming pool, lowering part of roof and alterations to front elevation.

    Additional representations were received from the applicant and Councillor Longworth.

RESOLVED:

That consideration of this application be deferred for a Members’ site visit.

(9) 54 Chester Square SW1 (TP 23096 / 5720) Erection of rear extension

    on 2nd to 4th floors, railings at 5th floor, infill conservatory and bridge link to mews building. Alterations to 54 Ebury Mews including basement swimming pool, lowering front part of roof and alterations to front elevation.

    Additional representations were received from the applicant and Councillor St. John Howe.

RESOLVED:

That consideration of this application be deferred for a Members’ site visit.

(10) Adrian House, 27 Vincent Square SW1 (TP 13486) Demolition of

    building behind Adrian House and construction of replacement building for use as a school (variation of scheme approved 17 December 1998). Erection for a temporary period (until 31 December 0 1) of two portacabin classrooms in Vincent Square school field.

    Additional representations were received from a local resident and a

    consultation response from the Thorney Island Society.

    RESOLVED:

    That planning permission be granted in accordance with the recommendation

    of the Director of Planning and Transportation, subject to the proposed

    condition No.15 being replaced with the new noise attenuation condition

    recently adopted by the Licensing Working Party, and with an additional

    condition to require adequate refuse storage.

    (11) 8 Wilton Place SW1 (TP 13643) Excavation at rear basement level to

    enlarge existing extension. Alterations to rear ground floor extension and

    fenestration. New window openings on flank elevation to Kinnerton Street and

    railings to balcony on front elevation.

    RESOLVED:

    That consideration of this application be deferred to permit discussions with

    the applicant on measures to lessen the sense of enclosure.

    (12) 22 Rutland Gate SW7 (TP 4779) Alterations to rear elevation

    including erection of extensions at ground and second floor levels.

    RESOLVED:

    That planning permission be granted in accordance with the recommendation

    of the Director of Planning and Transportation.

    (13) 24 Catherine Street WC2 (TP 1097) Removal and replacement of

    rear pitched roof with flat roof and installation of five air- conditioning units,

    within screened enclosure; erection of extract flue for WC's at roof level (site

    includes 23 Tavistock Street).

    Additional representations were received from a local resident.

    RESOLVED:

    That planning permission be refused on the ground of its impact on

    residential amenity.
