Job Title: Regional Consultants – Wills and Trusts

Responsible to: Wills and Trusts Solicitor & Legacy Marketing
Overall Purpose of the Job:
To support the legacy marketing team (which includes the Wills and Trusts
Service) in all legacy related work by delivering face-to-face meetings with
parents and carers about making a will and setting up a trust; to provide impartial
advice to parents and carers about their options when making their wills; to be an
ambassador for Mencap.
? To provide impartial legal advice to parents and carers about their wills via
face-to-face meetings in their homes
? To discuss the options open to parents and carers in relation to setting up
trusts, reviewing existing trust documentation and explaining how trusts
operate in simple terms;
? Follow up each meeting with written notes confirming the contents and
recommendations provided to the parent that supplied to both the client and
Mencap’s in-house wills and trusts solicitor. ? To encourage parents and carers to consider leaving a legacy to Mencap
when making or updating their wills;
? To promote, when appropriate other services such as Mencap Trust
? To discuss lasting powers of attorney, the Court of Protection and rules
surrounding this area of law;
? To represent Mencap in public as required from time to time;
? To ensure all activity is carried our in accordance with Charity Law, Trust Law
and Mencap policies and procedures; and
? To carry out other duties as requested by the Wills and Trusts Solicitor and
Legacy Manager as appropriate to Mencap's activities.

About the team
The legacy teams (legacy administration and legacy marketing) sit within the
individual giving department along other fundraising teams such as direct
marketing and trading.
Legacies account for around 45% of Mencap’s annual unrestricted income
The legacy marketing team runs Wills and trusts information service which combines a legacy ask with a much needed wills advice service to over 4000 parents and carers of people with a learning disability each year.
The legacy administration team administers the legacy income received by Mencap (almost ?5million last year) and deals on a daily basis with solicitors and lay executors administering estates under which Mencap has an interest.
Mencap also offers a trust service known as the Mencap Trust Company Limited, which sets up and runs discretionary trusts for people with a learning disability. This team is also based at National Centre with the legacy team.
About the role
This role is unique in its opportunity to work for Mencap across the country to advise about any issue relating to legacies whilst helping to provide a much needed and valued wills and trusts information and advice service to parents and families of a person with a learning disability.
As a freelance solicitor or ILEX, with a valid Law Society Practising Certificate and your own Professional Indemnity Insurance, you need to be willing to travel to meet parents and carers. Working within a defined region, a set remuneration fee per meeting will be offered, together with relevant travel expenses. It is envisaged that when the scheme is up and running, each consultant will be offered a minimum of 1 meeting per week.
