APPLICATION FOR CONSENT UNDER DELEGATED POWERS: DISPOSAL OF

    OPEN SPACE: LAND ADJACENT TO 14-20 LAIDLAW CLOSE, TALBOT

    VILLAGE, POOLE: REPORT OF THE ACTING HEAD OF PROPERTY SERVICES

1. REASON FOR THE REPORT

    1.1 Leisure Services declared this open space as surplus to requirements, stating

    that there is an exceptional circumstance that meets the necessary criteria for

    disposal under the Borough policy as there is no practical public access to the

    land that does not involve trespass. Further more, the land is of little visual

    amenity.

    1.2 All Heads of Service Units and Councillors were contacted and no objections

    to the disposal received.

    1.3 Under Section 123 (2A) of the Local Government Act 1972, the disposal to be

    advertised in the local press.

2. DECISION REQUIRED

    2.1 That consent be given to proceed with the disposal of open space land

    adjacent to 14-20 Laidlaw Close, Talbot Village, Poole.

    4.2 The land to be sold with the Borough’s usual covenants and be restricted for

    garden use only with no buildings / structures to be erected.

    4.3 Each plot shown on the plan to be sold to the adjoining owner and the

    exchange of contracts be simultaneous.

    4.4 Each owner to be responsible for erecting and maintaining fences to the

    boundaries to be agreed.

    4.5 Each owner to pay all of the Borough’s reasonable legal fees and surveyors

    costs.
