     Mr. Som Chand Katia is present in person. He has not received any information from the Municipal Corporation, Bathinda. There is a FAX message received from the Public Information Officer of Municipal Corporation, Bathinda, today morning at 11.43 A.M. Its number is 3552/RTI. The Public Information Officer has taken the plea that they have received the notice of hearing in the instant case only at 11.00 A.M. on 30.11.2007 and have sought a fresh date for the hearing.

    2. On the other hand, the Complainant, Mr. Som Chand Katia says that he has received the Commission‟s notice from the Deputy Registrar. Such

    excuses, according to him, on the part of the Municipal Corporation is nothing but delaying tactics. The case is adjourned to December 21, 2007 when the Public Information Officer should be personally present.

     “It is submitted that para-wise information is as under:-

     1) A representation from Sh.. Kamal Anand of Sangrur has been received in the Office of the Principal Secretary, Local Government, Punjab on 25.6.2007.

     2) This application has been sent to this office by Principal Secretary, Local Government, Punjab vide no.1866,, dated 25.6.2007 but this office did not receive that letter. Due to which further necessary action could not be taken.

     3) Due to non-availability of Compact Disc and representation further necessary action could not be taken.

    2. There has been inordinate delay in dealing with the application filed by the Complainant under the Right to Information Act, 2005, dated 12.7.2007 at the level of the office of the Principal Secretary, Local Government/Director-cum-Special Secretary, Local Government. In the light of the submission made by Director-cum- Special Secretary, Local Government, the best course for it is to contact the Complainant and seek another copy of the representation and the Compact Disc submitted along with application to the Public Information Officer of the office of Principal Secretary, Local Government.

    3. I direct the Public Information Officer of the office of Principal Secretary/ Director-cum-Special Secretary, Local Government to contact the Complainant, Mr. Kamal Anand., whose contact address is

     The Executive Officer, Municipal Council, Bassi Pathana, vide his letter No.800/E.O./2007, dated 27.11.2007, has sent a reply to Mr. Ashok Kumar, a copy of which was received in the Commission on 29.11.2007. 2. The Complainant says that he has not received any letter from the Executive Officer, Municipal Council, Bassi Pathana. Be that as it may, a copy of this letter be delivered to the Complainant again.

    3. In his application dated 27.08.2007, the Complainant has sought details about levy of fee for effecting change of ownership in the municipal records and a copy of Government Act/instructions/guidelines etc. on the said subject.

    4. Mr. Jagmohan Lal says that there is no Act or instructions or guidelines etc. to determine fee in such cases. For many years, he says, Rs.200/-. is being charged

    as transfer fee for effecting change of ownership in municipal record as per orders of the Executive Officer. In case of delay, composition fee is charged from the buyer. This is also mentioned in the letter of Executive Officer, dated 27.11.2007.

    5. This statement is contested by the Complainant who relies on the Punjab Municipal Act, 1911, to contend that the stand taken by the Respondent is not as law.

    6. At the next date of hearing, Public Information Officer of Municipal Council, Bassi Pathana, should appear personally to explain the correct position.

     The case is adjourned to December 21, 2007.
