    CARGO/SHIP LOST OR NOT LOST.

    9. OWNERS AGENT AT LOADING PORT AND CHARTERERS AGENT AT

    DISCHARGING PORT WITH REASONABLE/COMPETITIVE PORT D/A FOR OWNERS

    APPROVAL.

    10. LIGHTERAGE/LIGHTENING IF ANY TO BE FOR CHARTERERS' ACCOUNT AT BOTH

    ENDS.

    11. ONLY VESSELS PILOT TIME SHIFTING BETWEEN ANCHORAGE/BERTH,TIME OF

    FIRST OPENING AND LAST CLOSING THE HATCH AT LOADING/DISCHARGING

    PORT,DRAFT SURVEY AT LOADING PORT AND DISCHARGING PORT AND JOINT

    INSPECTION/QUARANTEE TIME TO BE FOR OWRERS’ ACCOUNT AND LAYTIME

    NOT TO COUNT. HOWEVER, CHARTERERS/SHIPPERS/RECEIVERS SHOULD NOT

    DELAY THE VESSEL ON ANY PURPOSE.

    12. OWNER ALSO SHALL PROVIDE SUFFICIENT LIGHT ON BOARD FOR LOADING

    AND DISCHARGING DURING NIGHT TIME, FREE OF CHARGE TO CHARTERERS. 13. TAXES, DUES, CHARGES ON CARGO/OCEAN FREIGHT AND VESSEL TO BE FOR

    CHARTERERS/OWNERS ACCOUNT.

    14. NOR TO BE TENDERED DURING WORKING HOURS (0800-1200, 1300-1800HOURS

    FM MONDAY TO SATURDAY AT LOADING PORT AND 0800-1200, 1300-1800HOURS

    FM MONDAY TO SUNDAY AT DISCHARGING PORT).

    17. CARGO TO BE RELEASED AGAINST ORIGINAL BS/L. IN CASE ORIGINAL B/L NOT

    ARRIVAL AT THE DISCHARGING PORT UPON VESSEL’S ARRIVAL,DISCHARGING

    AND RELEASING THE CARGO AGAINST CHARTERERS’ LOI IN OWNERS P&I

    FORMAT.

    18. QUANTITY TO BE ASCERTAINED BY DRAFT SURVEY WHICH TO BE ARRANGED

    BY CHARTERERS AND JOINT WITH MASTER/CHIEF OFFICIER

    19. OWNERS/MASTER TO GIVE AGENTS AND CHARTERERS VESSEL'S ETA NOTICE

    7/5/3/2/1 DAY(S) BEFORE VSL ARRIVAL AT L/D PORT.

    20. ANY DISPUTES TO BE REFERRED TO ARBITRATION IN HONG KONG ACCORDING

    TO ENGLISH LAW AND THE ARBITRATION SHALL BE CONDUCTED IN

    ACCORDANCE WITH THE SMALL CLAIMS PROCEDURE OF THE HONGKONG

    INTERNATIONAL ARBITRATION CENTRE. THE PARTIES AGREE TO APPOINT A

    SOLE ARBITRATOR AND THE AWARD SHALL BE FINAL..

    21. OWNERS GUARANTEE VESSEL’S GEARS SHALL BE IN GOOD CONDITION.

    AT LOADING BERTH: TIME LOST DUE TO GEARS BROKEN DOWN NOT TO COUNT

    AS LAYTIME; SHORECRANE, IF ANY, TO BE FOR CHTRS’ ACCOUNT.

    AT LOADING ANCHORAGE: IN CASE OF VSL’S GEAR BREAK DOWN AND

    LAYTIME TO BE DEDUCTED BASIS PRO-RATA AGAINST THE NUMBERS OF

    CRANES OUT OF ORDER; IF FLOATING CRANE REQUESTED TBF OWNERS ACCT,

    AND TIME TO COUNT AS LAYTIME DURING THE PERIOD OF TIME.

    SHORECRANE, IF ANY, AT DISCHARGING PORT TO BE FOR CHARTERERS

    ARRANGEMENT/ACCOUNT.

    22. COMMISSION:TOTAL 2.5% COMMISSION TO KAI SHUN(HK)INTERNATIONAL
