DECISION
A Commission hearing was held to determine whether Maddie’s Entertainment, Inc.,
d.b.a. Maddie’s Sail Loft was in violation of 204 CMR 2.05 (2)- Permitting an illegality on the
licensed premises, to wit: Ch.138 ?34C- Possession of an alcoholic beverage to a person under twenty-one years of age (1 Count).
The licensee stipulated to the facts of the investigator’s report (Exhibit 2). Investigator Paul Capurso testified that on June 21, 2007 at approximately 9:45 p.m. he and Investigator Wilichoski and Bailey had entered Maddie’s Sail Loft in order to determine the manner in which its business was conducted. The investigators observed a youthful looking patron, who produced a New Hampshire drivers license as a form of identification. The New Hampshire license turned out to be false. The youthful looking patron then produced a Maryland license and informed the investigators that he was not asked for identification prior to service. The youthful looking patron turned out to be 20 years old.
The licensee John Tangusso testified that the underage was the girlfriend of the bartender, who has since been terminated and the underage person has been barred from the establishment. The bar manager Douglas Moss testified that the new policy is to card everyone who appears 35 years old or less and to only accept one of the four (4) forms of acceptable identification. Administrative notice of the file reveals that the licensee has only been in business since March 2006.
The Commission finds that Maddie’s Entertainment, Inc., d.b.a. Maddie’s Sail Loft violated Ch.138 ?34C- Possession of an alcoholic beverage to a person under twenty-one years of age, and therefore suspends their license for a period of 3 days.
