The regularly scheduled meeting of the York Township

    Planning Commission was called to order at 6:00 p.m. by

    Chairman Nathaniel Burt.

Those in attendance were:

A motion was made to approve as presented the minutes of

    March 21, 2006.

SUBDIVISIONS AND LAND DEVELOPMENTS

LD2006-3-2: Cherrywood Land Development

    With regard to the Cherrywood condominium,

    Cherrywood Street, York Township File No.

    LD2006-3-2, waiver request only, I move that

    the waiver request for Section 305 be granted.

    With regard to waiver request, Section 602.J.2,

    regarding cart way width reduction to 20 feet

    Township Engineer’s letter of April 18, 2006, with further recommendation that all units provide in addition to two parking spaces in garages, two parking spaces in driveways in exchange for reduction of the cart way width.

    With regard to waiver request for Section 603.B, that the waiver request be granted in exchange for a monetary contribution for extension of concrete curbing from Woodside Drive along Cherry Street to Darlene Street in an amount substantially equal to cost of concrete sidewalks along that same section.

    In regards to York Township Land Development

    Plan 2006-3-1, Wright Brothers Land

    Development for 150 Pauline Drive, I would

    make a motion the plan be approved subject to

    the comments and requirements in the Township

    Engineer’s letter of April 15, 2006. In

    regards to the one waiver request for Section

    602.J.4 in regards to the reduction of the

    turning radius from 35 feet to 20 feet, I

    would make a motion that be approved as well.

P2006-3-1: Jeffrey J and Kathryn A. Edwards Subdivision

     Present: Philip Gross

    In regards to Edwards subdivision, Camp Betty

    Washington Road, Land Development Plan 2006-3-

    1, I make a motion that this land development

    plan be approved as presented with conditions

    and requirements of the Township Engineer’s

    letter of April 15, 2006. Regarding the

    waivers, Section 602.A.7, 603.C, 603.B and

    Section 402.C.1 be accepted as presented, and

    waiver for Section 610.A with a note that if

    the lot one sewer fails and the septic cannot

    be relocated that they must connect to the

    public sewer, and waiver 5, Section 610.B, if

    the lot one well fails and the well site

    cannot be relocated they must connect to

    public water.

     Lee Woodmansee

    In regards to Final Subdivision and Land

    Development Plan P2006-1-2 for the subdivision

    and LD2006-1-3 for the land development, I

    would make a motion that this plan be approved

    subject to the Township Engineer’s comments

    and requirements in his letter of April 18,

    2006. In regards to specifically issue number

    two, we would recommend that this issue be

    deferred to counsel to determine what was

    meant by the Zoning Hearing Board’s previous

    ruling. In regards to the waivers, waiver

    number one, Section 602.A.7, requiring

    pavement widening, I would move that that be

    approved; waiver number two, requiring

    sidewalks per Section 603.B, and waiver number

    three, requiring curbing per Section 603.C, I

    would recommend approval of both, and

    recommend that the equal amount of money is

    donated to the township in lieu of

    installation of the sidewalks and curbs;

    waiver number four for Section 402.C.3, I

    would make a motion that that be approved as

    well.

    MOTION PASSED 4-1 - Timothy Salvatore voted

    negatively.

    Timothy Salvatore made the following comment

    on his nay vote for inclusion in the minutes.

    “I disagree with the decision because I

    believe that issue number two must be resolved

    prior to consideration by the Commission, but

    agree with the decision in all other regards.”

P2006-1-1: William K. Bragg Subdivision

    With regards to the William K. Bragg Final Subdivision Plan, York Township File No. P2006-1-1, assuming that the Board of Commissioners grants permission to create flag lots, I move that we approve the plan as presented, subject to the requirements and conditions set forth in the Township Engineer’s letter of April 18, 2006. With regard to the waiver request, I move that waiver request for Section 602.A.7, 603.B, and 603.C be granted in exchange for acceptance of a monetary contribution from the applicant in lieu of installation of the required roadway improvements in an amount substantially equivalent to the cost of such improvements. With regard to waiver request for Section 402.C.1, that the waiver request be granted with the condition that the topography mapping of the areas proposed for home site sewage disposal system sites, well sites separation areas and access driveway areas in accordance with Section 402.C.2 be required, and that the requirements of 403.D.4 be postponed until submittal of an application to building permit for lots four and five. With regard to waiver request for Section 402.E.3, with regard to hydrologic report, water feasibility report, sewer feasibility report, traffic evaluation report, wetland report and Phase I

    environmental site assessment report, the waiver request be denied.

    MOTION PASSED 3-2 - Denise Roe and James Norton voted negatively.

    I further move that we recommend to the Board of Commissioners that the requested flag lots in the William K. Bragg Subdivision not be permitted as they do not appear to meet the spirit or the letter of the ordinance.
