    Withdrawal of permission of 4ft. Projection & 2ft. Platform from the allottee of Shop No. 96, Janpath, Municipal Market, New Delhi.

3. Brief history of the subject/project.

    The Civil Engg.Deptt. of NDMC has taken a project regarding redevelopment of Main Janpath Market. The redevelopment mainly include Façade improvement of the market. Inside improvement in the stall will be done by licensee. Project Leader has informed that Stall No. 96 has been allowed 4ft. projection and 2ft. platform with tin-shed roof which is not allowed to any other stall in the market. For the sake of uniformity, Estate Deptt. is proposing withdrawl of permission of 4ft. projection and 2ft. platform of Shop No. 96. Main Janpath Market, New Delhi.

4. Detailed proposal on the subject/project.

    The tenders were invited for allotment of Stall No. 96 Mpl. Mkt., Janpath adjacent to Stall No. 94 stall for area measuring 25ft.-6” x 8ft. The stall was allotted to Smt. Qaisar Jahan at the

    quoted rate of Rs.4112.56 + 5% being highest tenderer. On the request of Smt. Qaisar Jahan the then Committee vide Reso. No. 191 dt. 28.10.1975 had resolved that the stall adjacent to

    Stall No. 94, Janpath, measuring 25ft.-6” x 8ft. with 50% loft and 4ft. projection and 2ft.

    platform with a tin-shed roof be allotted to Mrs. Qaiser Jahan, W/o. Shri Haseen Ahmad at the highest tendered rate of Rs.4,112.56 plus its 5% per month for running the trade of Show Room and counter sale of Handicrafts. Further resolved that electric connection be provided in the stall. Power and water connections, if feasible, be also provided at the cost of the tenderer. Rolling shutters in the south side of the stall be allowed at her cost as per design to be prepared by the Architect Department subject to the condition that the permission will be revoked by the committee at any time without assigning any reason.

    Keeping in view the suggestion of Project Leader E.E.(B.M-III) we cannot allow 4ft. projection to this allottee to keep uniformity in the market. Further withdrawal of permission of 2ft. platform for avoiding/encroachment beyond shop allotted area is also recommended. It needs to be mentioned that as the rate of licence fee was quoted tendered rate of licence fee and rate was not enhanced while allowing her 50% loft + 4ft. projection and 2ft. platform hence the question of reducing of licence fee does not arise if the permission given for projection and platform is withdrawn.

Committee vide Resolution No.191 dated 20.10.75 has resolved (Annexure ‘A’) (See pages 22

     23) as under:-

    “Resolved that the Stall adjacent to Stall No.94, Janpath, measuring 25ft.-6”x 8ft. with 50%

    loft and 4ft. projection and 2ft. platform with a tin shed roof be allotted to Mrs. Qaiser Jehan W/o Shri Haseen Ahmad at the highest tendered rate of Rs.4,112.56 plus its 5% per month for running the trade of Show Room and Counter sale of Handicrafts. Further resolved that electric

The request for allowing additional space on tehbzari be, however, not granted. MOH may examine the possibility of removing the dumping place adjacent to the stall to some other place”.

13. Recommendation.

    Withdrawal of permission as mentioned in point No. 4 is recommended for consideration and approval.

    Resolved by the Council that withdrawal of permission of 4ft. Projection and 2ft. Platform is approved in respect of Stall No. 96, located at Municipal Market, Janpath, New Delhi.

    COUNCIL’S DECISION

    Resolved by the Council that withdrawal of permission of 4ft. Projection and 2ft. Platform is approved in respect of Stall No. 96, located at Municipal Market, Janpath, New Delhi.

    Further resolved by the Council that the approval was subject to reduction of increase in licence fee, if any, which might have been made on account of projection and platform, now proposed to be withdrawn.
