    1 PROCEDURE FOR REQUESTING SIDEWALK CAFÉ 2 LICENSE AGREEMENTS WITH THE CITY OF AUSTIN 3

    4 In order to process the request to enter into a license agreement, it is necessary that

    5 you furnish us with the following items:

    7 1. An application for a license agreement must be completed and signed by the

    8 Landowner and Licensee (Tenant).

    9

    10 2. Proof of ownership of the fee title to the property adjacent to the public street

    11 must accompany the application.

    13 3. A $35.00 $100.00 nonrefundable processing fee payable to the City of Austin due

    14 at the time of application is submitted. This fee was established by Ordinance

    15 Number 941208-H Section 15-9 20071129-040 “Sidewalk Café Ordinance”, 16 which amended Ordinance Number 20070910-008 “Fee Schedule” to be paid by 17 all Applicants.

    19 4. A certificate of insurance for general commercial liability insurance in the amount

    20 of $500,000 and $1,000,000 for liquor liability coverage (if applicable), naming 21 the City of Austin as an additional insured.

    23 5. A plan or sketch and preamble: sketch to scale and certified preamble (from a 24 registered Texas surveyor):

    26 Showing the dimensions from face of building to curb and width of sidewalk café

    27 parallel to curb must be provided with the application (see attached).

    29 The plan or sketch sketch to scale must also show the proposed locations of all up 30 to ten (10) tables, chairs, and related appurtenances proposed to be installed

    31 therein.

    33 6. Letters from Adjacent Property Owners and Tenants stating they do not object to

    34 tables being set out on right-of-way.

    35 City staff will prepare the License agreement. The applicant will pick up the license

    36 agreement for signature by the Landowner and Tenant, and return it to the Real Estate

    37 Division Right of Way Management Division with proof of insurance and a check in the

    38 amount of $200.00 for the first annual fee. The licensee agreement may apply for a one 39 year term be for a five-year term. Renewal: Applicant may apply for a one year renewal 40 period up to five year renewal of the license by submitting a $35.00 $100.00 application 41 fee, certificate of insurance and cashier’s check in the amount of $200.00 for the renewal

    42 year. Applications for renewal must be submitted no more than sixty (60) days or less

    43 than fifteen (15) days prior to expiration. Cancellation/Termination: License can be 44 canceled by licensee or by the City by giving ten (10) days written notice to the other

    45 party.

    63 and requirements set forth in the ordinance.

    65 1. An application for a license agreement must be completed and signed by the

    66 Landowner and Licensee (Tenant). Proof of ownership of the fee title to the

    67 property adjacent to the public street must accompany the application. A copy of 68 the food and beverage permit from TABC (Texas Alcohol and Beverage 69 Commission) if applicable, must accompany the application.

    71 2. A processing fee in the amount of $35.00 $100.00 must accompany the

    72 application. Checks should be made payable to the City of Austin. The $35.00 73 $100.00 fee is nonrefundable regardless of ultimate action by the City of Austin.

    75 3. Proof of general commercial liability insurance coverage by the insurer acceptable

    76 to the City in the amount of $600,000 $500,000 and $1,000,000 for liquor liability 77 coverage (if applicable), specifically for the sidewalk café and naming the City of

    78 Austin as an additional insured will be required prior to issuance of the license.

    80 4. A plan or sketch sketch showing the scale dimensions from the face of the

    81 building to curb and width of sidewalk café parallel to curb must be provided with

    82 the application. The plan or sketch must also show the proposed locations of all 83 up to ten (10) tables, chairs, and related appurtenances proposed to be installed

    84 therein. A certified preamble with a sketch prepared by a registered Texas 85 surveyor must be provided with application.

    87 5. The sidewalk area outside of the area used for the sidewalk café must have a

    88 minimum of

    89 six (6) feet of clear passage for pedestrians. Additional pedestrian passage area

    90 may be required based on pedestrian activity.

    91 6. Tables and chairs shall not be placed within ten (10) feet of interfere with an 92 entrance or doorway. (This distance is only measure in front of doorway no the

    93 sides.)

    94 7. No fences, walls, partitions, barriers, signs or other fixtures or objects may be

    95 placed in the sidewalk area with the exception that a removable free standing

    96 balustrade, planters, or appurtenances may be used to mark the boundaries of the

    97 sidewalk café. A canvas or cloth type canopy with a supported by single posts no

    98 greater than four (4") inches in width will be permitted.

    99 8. Licensee (Tenant) must remove the tables and chairs from the licensed area after

    100 close of business each day or night.

    101 9. Licensee (Tenant) must clean the licensed area and adjacent sidewalk and street

    102 areas of spills, debris, litter, etc. each day or night after the sidewalk café is closed

    103 and the tables, chairs, and all other appurtenance are removed. On a required

    104 basis, do a high-pressure cold water cleaning of the sidewalk.

105 10. The sidewalk café can only be in operation during the hours when the adjacent

    106 main restaurant is open. Licensee (Tenant) must place the approved preamble

    107 adjacent to the food and beverage permit (if applicable) in the main restaurant.

    108 11. Sidewalk café must comply under the Americans with Disabilities Act (ADA)

    109 requirements.

    110 12. The Property Owner/Licensee (Tenant) is responsible for condition of the

    111 sidewalk area if it is not suitable for use as a Sidewalk Café.

    113 13. City staff will prepare the license agreement. The applicant will pick up the

    114 license agreement for signature by the landowner and tenant, and return it to the

    115 Real Estate Division Right of Way Management Division with proof of insurance 116 and a cashier’s check in the amount of $200.00 for the first annual fee. The

    117 license agreement will may be for a one five year term. 118

    119 14. License can be canceled by licensee or by the City by giving a ten (10) days

    128 16. The list for reviewing departments, which is sixteen (16) departments, has been

    129 condensed to three departments. However, we want you to be aware that the

    130 remaining departments and private franchise holders may at anytime have utility

    131 maintenance. Many of these maintenance issues could not be perceived even if

    132 the departments that declined to review had reviewed the application. (Effective

    133 date of this change is 03/03/95).
