     TENDER NOTICE NO.DC/DREDGING/2009

1. Waxed Sealed tenders in 2 cover system (technical proposal to be

    marked “COVER ONE” and price proposal to be marked “COVER TWO) with

    EMD of Rs. 46.0 lakhs are invited from experienced contractors for

    undertaking the work of maintenance dredging for the year 2009, 2010 & 2011 on guaranteed depth basis and Capital dredging at Mormugao Port

    for the year 2009 by Trailer Hopper Suction Dredger preferably having 2 drag

    heads and a Cutter Suction Hopper Dredger with on-board electronic position

    fixing system (DGPS) so as to reach the office of the undersigned by 1500 hrs.

    on 08th June, 2009. Tenders received after notified time will not be

    entertained. Technical Cover(Cover No.1) will be opened at 1530 hrs on the

    same day in the presence of the tenderers who may wish to be present.

    2. The tenderer should own the dredger suitable for above work. However,

    if the tenderer is presently operating with a dredger on long term valid

    charter, he may also be considered. The trailer suction hopper dredger

    3(TSHD)/dredgers (maximum 2 Nos.) should be of minimum total 6500 m

    hopper capacity (upto 5% acceptable) keeping in mind the completion

    time and the location of the dumping ground. Minimum speed of the

    dredgers in fully loaded condition should not be less than 10 knots and in

    light condition not less than 12 knots (upto 5% acceptable). However,

    higher hopper capacity and speed will be preferred. The TSHD dredgers

    should be highly manoeuverable with twin screw and bow thruster in

    working condition. Contractor may use grab type or cutter type or any

    other type of dredger/equipment for maintenance dredging of barge

    unloading berth, Port Craft Jetty and alongside other berths & Capital

    dredging of additional Mooring Dolphin area. Contractor shall ensure that

    the berths and fenders are not damaged while dredging.

3. a) The maintenance dredging is required to be carried out in the navigational

    channel, approach to and alongside of berth nos. 5A, 6A, 8, 9, 10, 11 and end of

    berth no.11 as well as turning circles, Mooring Dolphin areas so as to achieve the

    designed depths varying from ()11 mtrs. to ()14.4 mtrs. with reference to

    Chart Datum.

    Barge unloading berths are to be dredged to ()6m and the port craft jetty to ()7m.

    with reference to Chart Datum. The designed depths at all berths has to be

    achieved right upto the berth face and edges of the channel. The estimated in-situ quantity of material to be dredged is approximately 4.0 million cubic metres consisting of silt, sand, clayey silt, sandy silt, hardened sand and spill cargo.

    Estimated quantity of approx. 1,00,000 cu.m. in the vicinity of breakwater (A3, A4 &

    A5 areas) consists of hardened sand and silt including small quantity of iron ore in the

    turning circle near the barge berths.. The contractor will have to deploy suitable drag

    heads with water jets etc. or an alternative dredger or equipment to tackle these hardened edges. No double handling charges will be payable. Payment will be made

    on the basis of insitu quantity dredged. Contractor may also encounter some small

    patches of compacted iron ore alongside the barge unloading berths. Contractor may

    deploy suitable equipment/methodology in these areas. The work has to be

    commenced by 25th August, 2009 and will have to be completed within 60

    weather-working days. However, the barge berth dredging shall commence by 5th

    August, 2009 and is to be completed by 5th September, 2009 every year.

    b) The Capital dredging of 12.99 lakhs m3 is required to be carried out of area for

    Mooring dolphin No.MD4, MD5, & MD6 and approach area from the existing bed level

    to (-) 14.1 m below chart datum and MD1 to MD3 from (-) 13.1m to (-) 14.1m below

    chart datum as indicated in drawings in all types of soils existing at site including

    loose or compacted sand, silt mixed with/without clay or any other material including

    boulders, spill cargoes and any broken concrete pieces, debris by suitable method by

    deploying trailer hopper suction dredger/cutter suction dredger/grab dredger. The

    thwork has to be commenced from 25 August 2009 and to be completed within 90

    weather working days except area of Mooring Dolphin MD6, is to be taken up in

    Phase II in Feb./March 2010 to be dredged to (-) 14.1 m. below the Chart Datum

    within 45 weather working days.

4. The prescribed tender form can be obtained from the port web site

    www.mptgoa.com or from the office of the Financial Adviser & Chief Accounts Officer, Mormugao Port Trust, Headland Sada, Goa from 16th May, 2009 upto 1000 hrs on 08th June, 2009 on a working day on payment of non-refundable sum of Rs.10,000/- (Rupees ten thousand only)

    per set by cash/D.D. Demand Draft should be drawn in favour of the

    Financial Advisor & chief Accounts Officer/MPT payable at Vasco da

    Gama. Tenderers/Bidders who have downloaded the tender document from

    the website shall submit the tender alongwith the cost of the tender document

    in form of Demand Draft as specified above.

5. The EMD of Rs. 46 lakhs shall be in Indian Rupees in the form of Demand

    Draft/Pay Order from a Nationalised Bank in favour of the Financial

    Advisor & Chief Accounts Officer, Mormugao Port Trust and

    payable at Vasco da Gama.

    6. The following will be the criteria for the pre-qualification for the work and the details of the same should be indicated separately in the technical bid,

    for 3 years ending March 2008. The tenderer shall submit a feedback from the

    concerned parties for satisfactorily executing the work.

    a) Turn over criteria : Annual turn over value Rs.23 crores

    b) Experience criteria : Total value or the total volume of work irrespec-

     tive of type of material for the purpose of pre-qualification will be

     3 works of Rs.16 crores or 12 lakhs cu.m. or 2 works of Rs.24 crores

     or 16 lakhs cu.m. or 1 work of Rs.32 crores or 24 lakhs cu.m.

    c) The tenderer should have completed at least one work of 60% of the

     value of contract or 3 works of value as stated above on guaranteed

     depth basis. Those bidders who have no experience in having done the

     work on guaranteed depth basis will be required to submit a performance

     guarantee of 40% of the contract value before the award of contract.

    4 Cost/quantity to be worked out on pro-rate basis where project exceeds over

    one year.

7. The tenderer shall submit copies of audited balance sheet for the past 3

    Solvency Certificate from any yrs. The tenderer shall also submit

    Scheduled bank in India for at least Rs. 60 crores.

8. In compliance with the dredging policy of MOS, Govt. of India, D.C.I.

    shall have the right of first refusal under section 406 & 407 of Merchant

    Shipping Act, if the rate is within 10% of the lowest technically qualified offer.

    To ensure level playing field between DCI and other Indian dredging

    companies, DG (Shipping) Mumbai has already modified its guidelines of

    November, 2002 to allow the first right of refusal to Indian shipping companies

    (under sections 406 and 407 of the Merchant Shipping Act) only if the bid of

    Indian companies is within 10% of the lowest offer. If more than one Indian

    companies including DCI participate in the tender, right of first refusal will

    go to that Indian company which has quoted the lowest and is within 10% of

    lowest technically qualified offer. D.C.I. or other Indian company selected on

    the above basis shall match the price with the lowest offer and carry out the

    work.

9. A pre-bid meeting will be held on 26th May, 2009 at 1100 hrs. in

    the office of the undersigned for discussions and clarifications of doubts. All

    bidders/tenderers shall be present for this meeting. Decisions taken

    during this meeting will form part of the tender.

10. The Mormugao Port Trust reserves the right to reject any or all the

    tenders without assigning reasons thereof.

    INSTRUCTIONS TO CONTRACTORS

    1. The amount of Earnest Money Deposit is Rs.46,00,000/-. The EMD should be in Indian Rupees in the form of Demand Draft/Pay order from a scheduled bank in favour of the Financial Adviser & Chief Accounts Officer, Mormugao Port Trust and payable at Vasco-da-Gama. The EMD should be submitted in a separate cover.

     Earnest Money in any form except as specified above will not be taken into account and the relative tender will not be considered. The earnest money will be refunded to the unsuccessful tenderers without interest after the tender is finalised. The earnest money will be refunded by a crossed cheque drawn on the State Bank of India, Vasco-da-Gama and the Board will not be responsible for reimbursing to the tenderers the Bank's commission for encashing the same or for the Bank's commission chargeable for issue of a demand draft. Alternatively, EMD will be refunded by Electronic Bank Transfer. Bank particulars shall be furnished by the tenderer.

    2. The tenderer shall submit alongwith his tender proof of filing I.T. returns or details of the PAN issued by the Income Tax department.

    3. The tenderer shall examine carefully the conditions of contract, specifications and drawings etc. supplied herewith. He shall inspect the site and on his own responsibility thoroughly acquaint himself with all local

    conditions, concerning materials, labour, nature of soil, width of the channels, space in front of berths, tidal conditions, weather conditions, swell conditions, working conditions at site etc. for the purpose of quoting in tender. All costs, charges and expenses that may be incurred by the tenderer in connection with such examination and for the submission of the tender shall be borne by him and the Board accepts no liability whatsoever thereof.

4. The contractor must follow the area-wise sequence of dredging as

    directed by the Deputy Conservator and complete the work within the stipulated date and time for each area to enable declaration of drafts as per end of monsoon season harbour notice. The type of dredger required to be used is trailer suction hopper dredger with provision to dump the materials by opening hopper doors. The tenderer should indicate the hopper capacity, number of drag heads, type of drag heads, speed in light condition, speed in loaded conditions, propulsion system, bow thrusters and other salient features in detail of the dredger. Preference will be given to a dredger having modern dredging equipment, drag head level indicator, jet pumps, loadicator/data processing equipment to measure, display and record output parameters and corresponding draft, echo sounder, track recorder for showing dredging track. The loadicator shall be calibrated to the satisfaction of the Board and the printout of the recorder as required shall be furnished with timings on each track for checking. All equipment shall be kept in good working condition throughout the contract period. No extra time will be made available for dredging alongside the berths and mooring dolphin area etc. due to non-functioning of dredging equipment or bow thruster etc

    Contractor may use Grab type or cutter type or any other type of dredger/equipment for maintenance dredging of barge unloading

    berths. Port craft jetty, alongside other berths and hardened edges of the channel and Capital Dredging of additional Mooring

    Dolphin/Mooring Dolphin area. Contractor shall ensure that the berths and fenders are not damaged while dredging.

    5. The rates quoted by the tenderer shall be for dredging per cubic metre of insitu quantity of dredged material and shall hold good till the work is completed.

    Mobilisation and de-mobilisation charges if any, should be indicated

    separately. Mobilisation charges shall be within 6% of the contract price and Demobilisation charges shall be within 1.5% of the contract price. Mobilisation charges will be paid after the arrival of the Trailer suction Hopper Dredger at the Port and on submission of the Bank Guarantee for an equivalent amount.

    In case of breakdown of the dredger, alternate dredger(s) has/have to be

    mobilised by the contractor without affecting the programme of completion of work. No mobilisation/ demobilisation charges will be paid by the Board for such substituted dredger(s).

    6. The frequency of shipping movements within the operational area may affect the contractor's dredging operations. Though all due care will be taken to avoid delays to the dredger, but no payment will be made by the Board for any suspension of dredging operations due to shipping movements etc. The contractor shall take this into account while quoting rates for dredging.

    7. All port dues including pilotage charges, port charges, shifting charges, mooring charges, tug and berth hire charges, except light dues will be to the account of the Board during the period of the contract. Hence, no deductions will therefore be made from any amount due to the contractor on above account. However, if port tug is used to assist in normal dredging operations, the hire charges for same will be deducted from the contractor’s bill.

    8. The Board shall endeavour to supply fresh water to the dredger during the period of maintenance dredging as requested by the master of the dredger and shall be charged by the Board to the contractor as per the MPT "Scale of Rates". Water may be arranged by ships agents if port is unable to provide due to scarcity.

     9. The contractor must engage private launches belonging to the Mormugao Launch Owners’ Association on his own for the purpose of changing the shift of the staff on the dredger and also for supplying provisions, for contractor’s use etc. at his own risk and cost. If the contractor wishes to use port’s survey

    launch for survey work, the same will be provided as and when available at the prescribed rates.

10. It is essential to have a local agent for liaising with the Marine Department, for

    the day to day requirement of the dredger and for attending the berthing meetings

    when required.

11. Quotes shall be exclusive of Service tax but inclusive of income tax, sale tax,

    octroi or any other State or Corporation tax or duty or levy or any other imposition

    of like nature.

     Any corrections to rates shall be supported by the tenderer's signature

    there-against. Tenders with over-writing will not be considered.

     Corrections to quoted rates shall not be allowed after opening of the tender.

12. It must be clearly understood that the rates quoted in the tender are to

    include for everything required to be done by the instructions to the tenderers,

    conditions of contract, specifications, maps and drawings, referred to therein

    and also for all such work as is necessary for the proper completion of the

    contract although specific mention thereof may have been omitted in the

    specifications or drawings. The rates are for works insitu and should be inclusive

    of incidentals necessary for carrying out the works, insurance cover for damage

    caused to the dredger or its equipment due to unforeseen or any other reason etc.

13. The tender shall be based on the conditions and specifications etc.

    stipulated in the instructions to tenderers. No deviation in tender conditions are

    permissible. Counter conditions if any shall not be accepted and the tender will be

    rejected.

     The tenderer shall alongwith the tender furnish general but clear particulars of

    his scheme for execution of the work inclusive of the plant and machinery which

    he intends to use.

     The tenderer shall produce satisfactory documentary evidence by way of works

    carried out by him during the past five years and their costs and time of completion

    with his tender to support his experience and ability for carrying out work of this

    class and magnitude.

     The tenderer shall note that the overall work must be completed within 90

    weather working days from the commencement of the work i.e from 25th August,

    2009. However, the barge berth dredging must commence by 5th August, 2009

    and be completed by 5th September, 2009. Date of completion of time will be

    counted from 25th August, 2009 even if the commencement of work is delayed

    by the contractor. The completion time for the maintenance dredging areas shall be

    restricted to 60 weather working days. However, pro-rata extra days will be allowed

    if the dredged quantity is more than estimated 4.0 million cubic meters or in case of

    delays in pre-dredging surveys due to inclement weather. No compensation will

    be paid to the contractor if the dredged quantity is less or more than the

    estimated quantity or in the case of delays in pre-dredge/post dredge

    surveys due to inclement weather. The rate quoted by the contractor

    shall be firm and Payment will be made at quoted rates for the actual

    insitu quantities dredged.
