1) Statement of Basis

In accordance with M.G.L. c. 111, ?142A-?142E, MassDEP issues this approval pursuant to 310 CMR 7.70.

2) Carbon Dioxide (CO) Emissions Monitoring 2

    The CO Budget unit(s) subject to the CO Budget Trading Program and the methods of CO mass emissions 222monitoring for the unit(s) are summarized in Table I below. The methods for determining hourly CO mass 2emissions contained in the monitoring plan meet the requirements of 310 CMR 7.70(8).

3) Net Output Monitoring

    The methods of net electric and net steam output monitoring for the facility subject to the CO Budget 2Trading Program are summarized in Tables II and III below.

The quality assurance/quality control procedures and the methods for determining net output contained in the

    net output documentation must continue to meet all applicable requirements in 310 CMR 7.70(8)(h).

4) Additional Requirements

    a. The application for this approval was submitted on July 25, 2008 and is attached. The terms and

    conditions in the completed application are hereby incorporated into the approval and the owner or

    operator of the CO budget source shall comply with all terms and conditions. This ECP approval 2

    consists of the application materials and this approval letter. If conflicting information is found

    between these documents, then the requirements of this ECP approval letter take precedence over the

    documentation in the application materials.

    b. This approval does not relieve the owner or operator of the CO budget source of the responsibility 2

    to conduct, maintain and operate the regulated activity in compliance with all applicable

    requirements of any federal or state agency. Nothing in this approval shall relieve the owner or

    operator of the CO budget source of other obligations under applicable federal, state or local law. 2

     c. This approval may be revoked, suspended, modified or transferred in accordance with applicable

    law.

     d. The owner or operator of the CObudget source shall comply with all recordkeeping and reporting 2

    requirements in 310 CMR 7.70(8).

     e. Pursuant to 310 CMR 7.70(3)(f)2., if the owner or operator of the CO budget source proposes a 2

    change to the approved CO mass emissions monitoring methodology for a non-ARP unit as 2

    described in Table I, then a revised AQ30 must be submitted to MassDEP for approval prior to

    making the modification. MassDEP will modify the ECP approval upon approval of the revised

    CO mass emissions monitoring methodology. 2

     f. Pursuant to 310 CMR 7.70(3)(f)2., if the owner or operator of the CO budget source proposes a 2

    change to the approved net output monitoring methodology as described in Tables II and III, then a

    revised AQ30 must be submitted to MassDEP for approval prior to making the modification.

    MassDEP will modify the ECP approval upon approval of the revised output monitoring plan.

     g. Pursuant to 310 CMR 7.70(2)(a)5, each submission under the CO Budget Trading Program shall 2

    be submitted, signed and certified by the COauthorized account representative or alternative 2

    authorized account representative as defined in 310 CMR 7.70.

APPEAL PROCESS

This CO Budget Trading Program Emission Control Plan approval is an action of the Department. If you 2

    are aggrieved by this action, you may request an adjudicatory hearing. A request for a hearing must be made in writing and postmarked within twenty-one (21) days of the date of issuance of this approval. A copy of the document being appealed must be attached to any hearing request.

    Under 310 CMR 1.01(6)(b), the request must state clearly and concisely the facts which are the grounds for the request, and the relief sought. Additionally, the request must state why the plan approval is not consistent with the applicable laws and regulations.

    The hearing request along with a valid check payable to the Commonwealth of Massachusetts in the amount of one hundred dollars ($100.00) must be mailed to:

    The request will be dismissed if the filing fee is not paid unless the appellant is exempt or granted a waiver as described below.

    The filing fee is not required if the appellant is a city or town (or municipal agency), county, or district of the Commonwealth of Massachusetts, or a municipal housing authority.

    The Department may waive the adjudicatory hearing filing fee for a person who shows that paying the fee will create an undue financial hardship. A person seeking a waiver must file, together with the hearing request as provided above, an affidavit setting forth the facts believed to support the claim of undue financial hardship.
