A. CALL TO ORDER
A Regular Meeting of the Kenai Peninsula Borough Road Service Area was held on
March 11, 2009, in Kenai Peninsula Borough Assembly Chambers. Acting Chairman
McLane called the meeting to order at 7:00 p.m.

MOTION TO APPROVE AGENDA: Blakeley moved for the approval of the agenda. Smith seconded.
Acting Chairman McLane called for additions, corrections or deletion to the agenda.

(7:06:50) D. APPROVAL OF MINUTES
MOTION TO APPROVE MINUTES: Blakeley moved for the approval of the March
11, 2009 minutes. Smith seconded.
Acting Chairman McLane called for additions, corrections or deletions to the minutes.
Mrs. Richardson asked the following amendments to the March minutes be approved:
1. Action Item I.1.A: Amended FY2010 RSA Budget amend VOTE ON MOTION
FROM MOTION FAILED TO MOTION PASSED.

E. CORRESPONDENCE - None (7:08:54)
Not proceeding with Ordinance Enacting KPB Chapter 16.06 Procedural
Provisions for Service Areas
Colette Thompson, KPB Legal Attorney, submitted a letter to all Service Area Boards
informing the mayor’s office will not be proceeding with the generic service area
ordinance presented in the April 14, 2009 RSA Board packet.
F. PUBLIC PRESENTATION WITH PRIOR NOTICE – (7:09:30)
Lee Wiley, PO Box 199, Clam Gulch, AK 99568 –He has been a contractor for the last
15 years. He disagrees with not allowing RSA Inspectors to take their RSA vehicle home
because it creates issues when needed immediately. He requests the RSA Inspectors
participate at the RSA Board meetings so they can answer questions that are asked.
Thanked the RSA staff and KPB for improving the maintenance on roads.
(7:12:43) Betty Porter – She resides on Even Lane and is afraid the water on the road will drain
into her garage. Even Lane is a dangerous impassible road for emergency vehicles to
(7:17:32) Barbara Roberts, PO Box 1722, Kenai, AK 99611 – She thanked Gary Knopp, KPB
Mayor and Jim Conner for meeting with her this summer regarding the road maintenance.
She requests the RSA Inspectors drive the subdivision roads to see the condition they are
in. She requests in writing when the road work will be constructed so she can present it
at their next subdivision meeting.
Acting Chairman McLane would like to provide Barbara the results of the 20 test holes
dug in the embankment and wheel path for the proposed RIAD. There are poor soils.
Joe Ross, 51137 Crest Avenue, Nikiski, AK 99635 – He request that school bus pull-outs are included in construction on capital improvement projects (CIP). He would like to
have the River Hills Subdivision residents pay to have their subdivision paved through a
RIAD instead of including the subdivision roads as part of the proposed road transfer
program with State DOT.
(7:27:20) G. PUBLIC PRESENTATION WITHOUT PRIOR NOTICE:
Acting Chairman McLane asked the public if any persons were wishing to
Curt Wagoner, 48277 Grant Ave., Soldotna, AK 99669 lived in this Willow Brook subdivision when Even Lane was accepted for Borough road maintenance. Even Lane
was approved by the engineer when the road was not built to road standards. When
residents bought parcels on this subdivision they were told the roads were build to road
standards. The RSA has only done minor work to improve this road. He would like to
have the RSA upgrade these roads to road standards. Subdivision Residents will then
agree to strip pave thru a RIAD.
H. PUBLIC HEARINGS – None (7:31:14)
I. ROAD DIRECTOR’S REPORT
I. 1 Action Items:
A. RSA Resolution 2009-03 Recommending That the State of Alaska
Revoke its March 20, 2006 Navigability Determination as to Salmon
Creek, Fourth of July Creek and Sawmill Creek, all located in the
vicinity of Seward, Alaska (7:31:35)
MOTION TO DISCUSS: Smith made a motion to discuss RSA Resolution 2009-03.
Ron Wille was appointed to the Flood Plain Task Force. The Flood Plain & Seward Bear
Creek Board would like to stop the gravel royalty fees applied to the flood mitigation
projects. This would allow more money spent on flood projects. RSA Resolution 2009-
03 is in support of this.
McLane requests KPB Legal to review the resolution before passing the resolution.
Acting Chairman McLane called for public comments with none being offered.
MOTION TO POSTPONE UNTIL MAY MEETING: Unanimous.
B. RSA Resolution 2009-04 Recommending Summer and Winter Road
Maintenance Contract Extensions (7:46:23)
Director Schoessler stated these are existing road maintenance contracts that are for three
years and may be extended for two (2) one-year terms.
MOTION TO ADOPT: Blakeley made a motion to adopt RSA Resolution 2009-04.

C. RSA Resolution 2009-05 Approving FY10 Capital Improvement
(7:48:08) Projects to be completed in 2010
Doug Schoessler presented RSA Resolution 2009-05 consisting of capital improvement
projects that are anticipated to be completed in FY2010.
Wille asked for confirmation that Beach Drive was listed previously as a FY09 capital
improvement project. McLane explained the project will not be completed until the
easements and ROW are obtained to allow proper drainage.
Acting Chairman McLane called for public comment with none being offered.

1.2. Informational Items.
A. ADOT & PF Highway & Transit Projects – Stimulus & STIP 58) (7:51:20)
Director Schoessler presented a list of STIP projects the RSA is working with the State to
be completed. There is not a complete list at this time.
B. Increase Road Maintenance - verbal (7:51:56)
Director Schoessler stated Ordinance 2008-19-45 was passed by the assembly allowing
$750,000 of CIP funds be transferred to Road Maintenance fund. These additional will
allow better road maintenance to thaw frozen culverts to reduce flooding and make small
roads repairs allowing residents to get home during break-up.
C. Financial Report 7:53:42)
Director Schoessler presented the financial statement for period ending 4/9/09.
J. BOARD & STAFF COMMENTS:
Kevin Smith - Lives off Even Lane and agrees with the residents that the road is in
terrible shape and would like improvements done this summer. (7:54:25)
Norm Blakeley - Thanked the RSA Inspector for maintaining and grading Otter Trail.
Hugh Chumley - Thanked the RSA staff for their work. (7:55:50)
(7:55:53) Mayor Carey – Falls Creek Bridge will not be open during construction. The governor
does not have the $20m to upgrade three new bridges. These funds will be moved to the
Dalton Highway; leaving fewer funds available. The State bid three bridge projects from
Kasilof, Deep Creek to Ninilchik as one project and will be working on them at same
time. He is concerned about the traffic volume with the road closures during the
construction period. (7:55:59)
Henry Knackstedt – There are many capital improvement projects going out for
construction this summer. The road closures going to Seward may impact the Stoney
Creek paving project. (7:57:30)
Jim Conner – Hugh, Doug, and he met with Matsu Borough and Fairbanks North Star
Borough. They shared ideas and documentation for maintenance that may help over the
next couple of years. (7:58:34)
Director Schoessler – Thanked the staff and RSA Board for assisting him. (8:00:01)
Sam McLane - Would like RSA Inspector be allowed to take their Borough vehicles
home because they work out of their home offices which are scattered out in the Borough.
He would ask this decision be reviewed because they are on-call status. He would like
better communication between the RSA Board and the RSA Inspectors and requests the
inspectors attend meetings so they may answer and questions. (8:00:34)
He does not agree the State DOT should close the road down during the summer season.
Would like the RSA Staff draft a letter to the State governor and Mike Chenault
disapproving with the road closure and action we are getting from DOT. (8:00:34)
Ron Wille - Thanked Mayor Carey for looking into the bridge closure issues. Trail Lake
Bridge project closed the whole highway from Friday to Monday. Other restrictions will
be placed a couple days a month throughout the summer for road inspections. Weight
restrictions will be placed load limit to 30,000 lbs., which will create issues in Seward for
fisheries and tour buses. (8:05:32)
K. SET MEETING TIME.
The next meeting of the Kenai Peninsula Borough Road Service Area has been
scheduled for May 12, 2009 at 7:00 p.m. at the Seward City Hall, Seward, Alaska
With no further business to come before to come before the RSA Board, Acting
Chairman McLane adjourned the meeting.
